Your agreement with Dearly
These Terms of Use are an agreement between you and Dearly, operated by Mojeeb Titilayo in Ogun State, Nigeria. By creating a greeting, publishing a contribution, creating an account, signing in, or otherwise using Dearly, you agree to these terms and the Privacy Policy.
If you do not agree, do not submit content or create an account. If you use Dearly for an organization or another person, you confirm that you have authority to accept these terms for them.
What Dearly provides today
Dearly helps people celebrate people and preserve what matters. The current service lets a creator provide details about someone, receive an AI-assisted draft greeting, optionally add a photo, publish a shareable page, and save owned greetings in a signed-in archive. Certain special pages also let visitors publish wishes or condolence messages.
Dearly is a creative communication service, not secure private storage, a permanent archive, professional counseling, or a substitute for legal, medical, financial, or emergency services. Features described in product-roadmap material—including private Memory Spaces, Celebration Cakes, merchant tools, gifts, and payments—are not part of these terms until launched with any additional rules they require.
Eligibility, accounts, and sign-in
- You must be at least 13. If your country requires a higher age to consent to online services, you need permission from a parent or legal guardian until that age.
- You must provide an email address you control when using email sign-in. If you choose Google sign-in, you authorize Dearly and Supabase to use the basic Google identity data described in the Privacy Policy.
- Keep magic links, devices, and account sessions secure. You are responsible for activity carried out through your account until you notify us of unauthorized use.
- Do not create accounts through bots, false identities, or credentials belonging to another person.
A random claim secret may let a signed-out creator attach a newly created greeting to an account for 24 hours. Possession of a public greeting link alone does not prove ownership.
Greeting links are public, not private
Greeting pages, uploaded greeting photos, public wishes, and public condolence messages can be viewed by anyone who receives or discovers the URL. They can be copied, captured, reshared, or indexed by search engines. A hard-to-guess link is not a confidentiality promise. Do not publish information that should remain private.
Your “My Greetings” archive and its ownership records are account-private, but opening a greeting from that archive leads to its public page. You are responsible for choosing who receives the link and for obtaining any permission required before publishing content about someone else.
Your content, ownership, and permissions
Between you and Dearly, you keep the rights you have in names, prompts, photographs, messages, and other content you submit (“Your Content”). You grant Dearly a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, display, and process Your Content only as reasonably necessary to operate, secure, improve, and provide the features you choose—including generating the draft and displaying the public page. This license ends when the content is deleted, except for reasonable backup, legal, and security retention and copies made independently by other people.
You promise that:
- you own Your Content or have all permission and lawful authority needed to submit and publish it;
- your submission and Dearly's permitted use will not violate privacy, confidentiality, publicity, copyright, trademark, or other rights;
- information you provide is not deliberately deceptive or unlawfully harmful; and
- when content concerns a child, you have parental or legal authority and have considered the risks of public sharing.
Dearly's software, interface, logo, visual system, and original materials remain owned by Dearly or its licensors. These terms do not give you a right to copy the service, branding, or code except as the law expressly permits.
AI-generated drafts need human review
Dearly uses Google Gemini to help draft greeting text from the details you provide. AI output may be inaccurate, unsuitable, incomplete, offensive, or similar to output produced for others. You must review the result and decide whether it is appropriate before sharing it. You are responsible for the final content you choose to publish or send.
Do not rely on an AI-generated greeting as factual advice or as a statement from Dearly about any person. You do not receive exclusive rights to ideas or text that the law does not protect, and Dearly does not guarantee that generated material can be copyrighted or is free from every third-party claim.
Acceptable use
You must not use Dearly to:
- break a law, court order, sanction, or another person's legal rights;
- harass, threaten, shame, exploit, defame, stalk, discriminate against, or impersonate someone;
- publish non-consensual intimate material, sexual content involving minors, or content that facilitates abuse or exploitation;
- expose passwords, authentication links, financial details, government identifiers, addresses, precise locations, or other information likely to create material harm;
- infringe intellectual property, privacy, publicity, confidentiality, or data-protection rights;
- send spam, phishing, malware, deceptive links, or mass unsolicited promotions;
- probe, bypass, overwhelm, reverse engineer, scrape at scale, or interfere with security, rate limits, accounts, storage, or service operation; or
- train or benchmark another model or competing service from Dearly content or outputs without written permission where such restriction is lawful.
Moderation, reports, and removal
Dearly may investigate reports and may block, restrict, unpublish, remove, preserve, or disclose content or account information when reasonably necessary to enforce these terms, protect people, comply with law, or secure the service. We are not required to pre-screen every greeting and do not endorse user submissions.
To report a privacy, safety, copyright, or impersonation concern, email hello@mojeeb.xyz with the page URL, the specific concern, and your connection to the content. We may ask for proportionate verification. Knowingly false or abusive reports may themselves violate these terms.
Third-party services and links
Dearly relies on providers such as Supabase, Google, Vercel, Umami, and Fontshare. Their systems, service terms, and privacy practices also apply to their processing. Dearly pages may include user-directed links or sharing actions to other services. We do not control third-party sites and are not responsible for their content, availability, security, or independent use of information.
The current service is free; commerce is not live
Dearly does not currently charge users through this application, process payment cards, sell gifts, or operate merchant checkout. “Free” descriptions refer to the current greeting creation flow and do not promise that every future feature will remain free. Before introducing a paid or merchant feature, Dearly will present the price, currency, taxes, fulfillment terms, cancellation or refund rules, and any additional agreement that applies before purchase.
Availability, changes, and ending use
Dearly may change, limit, suspend, or discontinue a feature to maintain security, meet legal requirements, manage capacity, or improve the product. We will try to give reasonable notice before a material discontinuation when practical, but urgent security, abuse, legal, or infrastructure events may require immediate action.
You may stop using Dearly at any time and may request account or content deletion as described in the Privacy Policy. Dearly may suspend or terminate access for material or repeated violations, legal risk, fraud, or threats to users or the service. Provisions that by their nature should continue—including ownership, disclaimers, liability limits, and dispute terms—survive termination.
Service disclaimers
To the fullest extent permitted by law, Dearly is provided “as is” and “as available.” We do not promise uninterrupted operation, permanent storage, error-free AI output, a particular emotional response, search removal by third parties, or that the service will meet every cultural, personal, or technical expectation. Back up content that matters to you.
Nothing in these terms excludes warranties or remedies that applicable consumer law says cannot be excluded. If a mandatory guarantee applies, these terms limit Dearly's obligations only to the extent the law permits.
Responsibility and limits on liability
You are responsible for Your Content, the people and permissions involved, and how you share public links. If your unlawful content or misuse causes a third-party claim against Dearly, you agree—where the law permits—to reimburse reasonable losses and costs directly resulting from that breach, provided Dearly gives you prompt notice and reasonable cooperation.
To the fullest extent permitted by law, Dearly and its operator will not be liable for indirect, consequential, special, exemplary, or punitive loss; lost profits or data; reputational or emotional harm; third-party reposting; or events outside reasonable control. For claims relating to a free service, aggregate liability will not exceed the greater of the amount you paid Dearly for the relevant service in the 12 months before the claim or US$50.
These limits do not apply to fraud, willful misconduct, liability that cannot legally be limited, or any mandatory consumer or data-protection right.
Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Before filing a claim, you and Dearly agree to make a good-faith attempt to resolve it by email for at least 30 days, unless urgent relief or a legal deadline makes that impractical.
Nigerian courts will have jurisdiction where the law permits. This choice does not remove any mandatory consumer, privacy, or court-access protection you have under the law of your usual residence.
Changes, separation, and contact
Dearly may update these terms as the service changes. We will change the date above and provide additional notice before a material change takes effect when required. Continued use after the effective date means you accept the updated terms; if you do not, stop using the service and request deletion where appropriate.
If one provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. These terms and the Privacy Policy are the agreement for the current service unless a feature presents additional terms.
